Those who receive a complaint must file an Answer within a certain number of days after receiving it. The time frame for answering varies from 20 to 35 days, depending on which state you are in and where the complaint was filed. In New Jersey the time limit is 35 days if you are sued in state court and 20 days if you are sued in federal court.
While a complaint can be delivered through postal mail, in New Jersey it is usually better for the plaintiff to use the help of a constable, sheriff or private service company to serve the complaint. “Service” refers to a process in which the complaint is delivered to the correct person or entity. A service company will provide an affidavit of service, which the plaintiff must then file with the court to confirm the delivery and receipt.
