Property Settlement Agreement

Assuming the parties to a divorce action are able to reach a resolution of their issue, such resolution is usually written upon a document celled a Property Settlement Agreement. A Property Settlement Agreement usually covers each and every issue that the parties have reached resolution on, signed by the parties, and becomes a binding contract between them. In the event that the parties are able to reach resolution, and the resolutions of their issues are set forth in a property settlement agreement, the parties then proceed to divorce on what’s called an Uncontested Basis. In an Uncontested hearing, the plaintiff would appear before the judge, and would swear that the parties had entered into a agreement, called a property settlement agreement, and would request that the judge enter the divorce incorporating the terms of the property settlement agreement, so that the parties would thereafter forever be bound by the terms thereof.
