Discovery

After the complaint has been filed, and the answer has been filed with or without a counterclaim, the parties then engage in a process which called Discovery. Now discovery can include several things including interrogatories, depositions, and in matrimonial cases filing the case information statements.
Interrogatories are procedures by which each party gets to ask the other party questions in the form of writing. One party will write questions for the other party to answer and vice versa. Depositions are procedure by which each party gets to ask the other party oral questions under oath, in front of a court reporter. In matrimonial cases in the state of New Jersey in addition to other discovery methods, the parties are required to file what’s called a case information statement. Now case information statement contains various biographical and financial information relative to each party, including such things as income and expenses.
